From BarbWiki
It sounds like copyright should not be a problem. We may have to make some changes later, but I suspect not. See email below for info on the status:
Hello Colin & Tony,
Good news - the preliminary legal review indicates that our reproduction of abstracts for use is the BARB project would qualify as fair dealing. However there may be some limitations - such as a maximum word count/ logging that we will have to adhere to. I will fwd our IP lawyer's formal opinion for your files once I receive it and we can then establish some general guidelines if need be.
Thanks, Rachel

Ms. Conroy,
I have been assigned to review your questions concerning the use of journal abstracts for an online bibliography for the Athabasca River Basin project.
I have spent some time reviewing copyright, fair comment rights and the exceptions which apply to educational institutions.
I will be preparing a formal response to you shortly, but my conclusions from the research are that AU is likely covered by fair comment in this endeavor provided that it is related to activities such as research, private study and review. Moreover, you will be required to list the source of the material, author name, etc. contrasted with the effects of the marketability of the original work. Finally, the abstracts should be limited in scope as to not disclose any substantial portion of the work copyrighted.
Please feel free to contact me at any time and I will be reporting to you more formally in due course.
Sincerely,
Jon
